11 Times The Second Amendment Was Attacked And Prevailed

The Second Amendment gives Americans the right to bear arms. This amendment to the Constitution was originally introduced in 1789 but it hasn’t been left alone quietly. The Second Amendment has been attacked more than any other right laid out in the Constitution but it’s prevailed every time. This infographic takes a look at 11 of the most prevailing examples of this amendment over the years.

The first case to cite the Second Amendment was the Supreme Court’s Nunn v. Georgia decision. This overturned Georgia law which banned the possession of handguns among private citizens until 1846.

 Another complaint against the Second Amendment is that the phrase “the people” was too vague. This is another aspect of the amendment that has been addressed multiple times with rulings such as United States v. Verdugo-Urquirdo including legal aliens into the amendment.

In 2009, McDonald v. Chicago expanded the right to private citizens in every state and, a year later, United States v. Day specified this language into firearms being a right to every law-abiding citizen.

 The law has even tackled the specifics of what weapons qualify under this right and the condition you’re allowed to keep them in. By the 2008 District of Columbia v. Heller verdict, homeowners were officially allowed to keep the guns in their own homes “locked and loaded” if they saw fit. A 2016 case, Caeteno v. Massachusetts, allowed citizens the right to own stun guns just as much as their other firearms.


Even indirect barriers to gun ownership have been challenged over the years. With cases like U.S. District Court Chief Judge Ramona v. Manglona, Second Amendment advocates won out again with a ruling against the excessive taxation.


What these cases and the others in this infographic demonstrate is clear. The Second Amendment has long been under fire and scrutiny but it has continuously come out on top.
